100 CENTRE STREET, Oct 1 – A man arrested and charged for the gun and drugs found during a warranted search of his NYCHA housing project apartment is on trial before NYS Justice April A. Newbauer.
On Wednesday the NYPD officer who conducted the search was on the stand, being repetitively questioned by the ADA.
The ADA asked, What is this?
The officer replied that it was a box of bullets, and a speed-loader. He said he had used one himself, and so knew what it was. He could not, however, remember the voucher number he had used.
Let me refresh your recollection, the ADA said.
Defense counsel passed up his copy of the discovery. Before the body-cam footage of the search was shown, he consented to the presentation of his client’s NYCHA lease to the jury, but not to other documents found in the apartment.
As the Yom Kippur holiday approached, Justice Newbauer asked the ADA if she would insist on questioning about each vouchering of each item.
Yes, the ADA said.
Then we will break, Justice Newbauer said.
