100 CENTRE STREET, Sept 25 – A man charged in two separate grand larceny indictments was ready to plead guilty on September 25, his appointed lawyer said.
Only he wasn’t.
“I want to fire my lawyer,” the defendant told NYS Justice April A. Newbauer.
But no change of counsel proceeding was scheduled, at least not yet.
Instead, while lawyer and client audibly bickered at defense table, Justice Newbauer asked the prosecutor, if this defendant was a predicate felon, how could he be offered 364 days - wouldn’t two to four years be the minimum?
The ADA replied that the offer was for three to six years.
“I’ll take two to four right now,” the defendant said loudly.
But it was not to be.
Justice Newbauer urged lawyer and client to spend more time talking, and to return on September 30, that she would see them sometime around witnesses in the trial she will be presiding over.
