FEDERAL COURT, August 20 -- DDC Magistrate Judge Robin Meriweather on August 20 had before him Floyd Ray Roseberry, a day out of the car bomb vehicle by the Capitol. Roseberry, near tears, said hadn't taken his medication. He remains detained pending a competency test; the US will be seeking his detention regardless. Inner City Press live tweeted it,

here:

On US v. Ray Roseberry, Inner City Press aims to live tweet his appearance before DDC Magistrate Judge Zia Faruqui - surmise from cross-talk that the docket number is 21-MAG-573, on PACER it's SEALED v. SEALED; Case is not available to the public.

Judge Faruqui: Have you taken any medication? Roseberry: I think not having my medication has made things worse. Judge Faruqui:

Mr. Roseberry, what haven't you been receiving? Roseberry: Blood pressure [voice cracks - very Southern accent] Judge Faruqui: Public defender, have you spoken with his wife?

PD: We knew about the events of yesterday, but only got assigned 10 minutes ago. We will not be taking a position... Judge Faruqui: I can't go forward if he does not understand.

AUSA: Your proposal makes sense to the government. Judge Faruqui: We'll make sure you get your medication. Roseberry: Yes sir thank you [voice cracking again - crying?] Judge Faruqui: We need to discuss pre trial detention

Judge Faruqui: It's difficult for you to understand what is going on without your medication.  [So he will be detained, on this ground] Roseberry: I can tell in your voice you're a good man. I'll do anything you say.

Judge Faruqui: We believe you are innocent, that's our job as judges. But these are the charges against you: threats of use of weapon of mass destruction, maximum is life imprisonment.

Judge Faruqui: The government always does it's level best to get defendants discovery quickly. [What about the delayed Jan 6 video database with Deloitte?] Now a competency screening for Roseberry is being requested. Judge Faruqui: It is warranted, by Doctor Grant

Judge Faruqui: It will take a couple of days. We will set it up offline and try to do it Monday. We'll issue a minute order/ [Note: Earlier today Copeland was found to be competent - and still detained, sealing fight

Judge Faruqui: I can't make any promises. If you are not competent, how do I get you into condition? Does that make sense Mr. Roseberry? Roseberry: Yes sir [no wavering of voice] Defense: We were going to come back Wednesday. In the afternoon.

Judge Faruqui: So on the 25th, 4 pm. AUSA: We'll be moving for detention; we'll argue at the appropriate time. Roseberry: Thank y'all for y'all's time. Judge Faruqui mentions unsealing - we'll see.

Update: at the end, Judge Faruqui was told that a lawyer would just stay on for the 3 pm proceeding, in 10 minutes.  Judge Faruqui: "That's a sealed proceeding." Line went dead. Nothing listed in calendar... Watch this feed.

On August 5, Inner City Press filed a letter and motion with DDC Judge Mehta, on its DocumentCloud here.

On August 16, this: "Judge Mehta is in receipt of your email requesting access to the videos filed in United States v. Harrelson, No. 21-cr-28-10.  Under Standing Order No. 21-28, in order for the court to grant Inner City Press access to the videos filed in Mr. Harrelson’s case, you will need to file an application for access pursuant to D.D.C. Local Criminal Rule 57.6."

So, citing the Rule, Inner City Press filed another letter, one page, now docketed here.Granted.Story with video link.
