FEDERAL COURT, Feb 5 – Jenny Cudd and Eliel Rosa, charged with on January 6 having "entered the Capitol without authorization," appeared on January 21 before U.S. District Court for the District of Columbia Magistrate Judge G. Michael Harvey.
Inner City Press which is covering #insurrectionBlues (Harvey song here) live tweeted the proceeding here and below.
Now on February 5, the District Judge to whom the case was transferred has granted Cudd's unopposed motion to travel to Mexico, order on Patreon here:
"Defendant Jenny Louise Cudd seeks permission for pre-paid, work-related travel to Mexico from February 18, 2021 through February 21, 2021. See ECF No. 13. Neither Defendant’s Pretrial Services Officer nor the Government oppose this request. Id. ¶¶ 6–7. The Court also notes the Defendant has no criminal history and there is no evidence before the Court suggesting the Defendant is a flight risk or poses a danger to others. For these reasons, it is hereby ORDERED that Defendant’s Unopposed [13] Motion to Travel is GRANTED; and it is further ORDERED that Defendant shall provide her itinerary to her supervising Pretrial Services Officer and follow any other instructions provided by Pretrial Services. SO ORDERED. Dated: February 5, 2021 TREVOR N. McFADDEN, U.S.D.J."
US says on Jan 6 "Jenny Louise Cudd, also known as Jenny Haning Cudd on social media platforms, and Eliel Rosa entered the US Capitol without authorization... Afterwards, Jenny Louise Cudd streamed a live video, via Facebook, which is a social media platform."
Oh.
Cudd: Half way through my Masters program. Eliel Rosa, also on the line, is 53. He is getting a free lawyer - Cudd has her own retained counsel.
Eliel Rosa is getting consular notification. He is not a US citizen.
Rosa: Thank you your Honor.
AUSA: We are not seeking detention. Standard supervision: stay away from DC unless for court or pre-trial or to meet attorney. No travel outside of US without Court
Ms. Cudd has a legal firearm and has applied travel to Mexico Feb 18-21.
Judge Harvey said he would consider.
Then on February 1, a formal application and proposed order for the travel was filed, Inner City Press tweeted the photo here. There has been no ruling. Yet.
