SDNY Exclusive follow up, Jan 30 - For taking and transporting Ashley Biden's diary from Florida to New York, guilty pleas on no notice were entered on August 25 by Robert Kurlander and Aimee Harris. Inner City Press was there, and live tweeted, here and below.
Before U.S. District Court for the Southern District of New York Magistrate Judge Sarah L. Cave, first Kurlander then Harris were brought out of the holding cell by US Marshals, and pled guilty. Inner City Press' thread is here and below.
On January 29, the day before her sentencing scheduled for January 30, Harris wrote in through counsel to ask to appear by video to request an adjournment, saying she is sick and has no childcare.
On January 30, Inner City Press was in the courtroom. At first, Harris would not unmute; when she did there was shouting, police radio squawk, and a stand-off. Thread:

Prosecutor, speaking before Judge comes in: If thete were documentation supporting adjournment.. But there's not... She has not been responding. Defense: I hear you.

All rise! Defense: Ms Harris is joining us from a hospital in Florida. Judge: Ms Harris, please unmute yourself. Defense: We are texting her. Judge: Is she respinding? Defense: No.
Judge: I order you to unmute and speak... Judge: Ms Harris, you are not in compliance... Defense: She has not responded to either CJA lawyer... We were told. She went to the ER at 11:20 am... I don't think a bench warrant should be issued today
Judge: I thought the father had custody of the children AUSA: Ms Harris has represented she shares custody, but Pre Trial Services has not been able to confirm. We're skeptical. Judge: This is unusual. There is a public interest in moving to sentencing.
Judge: We could set a date for remote sentencing. Harris: I'm in an emergency room, there's a woman screaming and police coming. My mother was supposed to come
Judge: We may mute yourself. Harris: The police are standing over the woman... Thank you, your Honor. Defense: I have an EDNY trial starting Feb 12, if we can do this before then AUSA: She does not respond to Pre Trial, they had to call her mother.
AUSA: Ms Harris is not working. We ask the Court to request medical documentation. Defense: She does work... These are real issues. I could give a date tomorrow Judge: I am preparing an order now
Judge: Ms Harris is directed by Jan 31 at 5 pm a date for sentencing and documentation of today's E.R. visit. Defense: She dropped... she's back. Harris: I don't know if the next 2 weeks are possible Judge: More delaywould require extraordinary circumstances
Judge: Ms. Harris, you must provide that information to your lawyer. And I hope you feel better. Harris: Thank you Your Honor. Adjourned.
