In DC Insurrection Case, Judge Ketanji Jackson Rejects DOJ Tolling Speedy Trial Act Time For "Global" Discovery
This is a trend: as DOJ goes big, with video and seeking complex case status, defense attorneys and now several DDC (and here, nominated for DC Circuit) judges push back for individual justice

FEDERAL COURT, March 31 – Minutes into a break in the impeachment trial in the U.S. Senate, accused insurrectionist Domenic Pezzola was ordered detained until trial by Magistrate Judge Robin M. Meriweather. Inner City Press live tweeted it, below. There was an appeal.
Now on March 31, after the DC Circuit's decision in US v. Munchel, DDC District Judge Ketanji Brown Jackson, nominated for the DC Circuit, rejected DOJ attempt to exclude Speedy Trial Act time until it provides a huge tranche of videos to all or most defendants. It was in the case of US v. Brian Gundersen, and Inner City Press live tweeted it, here:
Assistant US Attorney Birney says even in a few weeks he won't have the discovery ready, because of the wider case.
Judge Ketanji B. Jackson: Mr Ohm? Federal Defender Ohm: This is disturbing. Discovery is the info used to prosecute Mr. Gundersen, not gazillion videos
Ohm: It's like saying, here's 5000 hours of jail calls, we're going to use two of them. Judge: I think he said the government wants to give all defense attorneys all of the videos. Ohm: It only works if they identify which parts they're going to use.
Federal Defender Ohm: DOJ shouldn't bring a case if it is not ready to prosecute. They could dismiss and re-start. But instead they want an indefinite pause. Why should we agree to exclude [Speedy Trial Act] time until May 19? This is not acceptable.
Judge Ketanji: Mr. Ohm's concerns are reasonable. Hopefully [AUSA] Birney can make some headway in his office in terms of inquiring about a pre-trial disposition. My reaction is to amend the courts order on Speedy Trial and have us come back on April 30 AUSA Birney: I'm away. How about May 6?
Federal Defender Ohm: I'd like it a week before April 30. Or a commitment on when discovery will be available.
AUSA: Mr. Ohm is going to get video of his client in the Capitol, 302s and video of his client being in the Capitol.
Judge Jackson: So April 22 at 10:30 am. I'll sign the protective order. Adjourned.
