FEDERAL COURT, Nov 29 -- On November 29, months after the DC Circuit's decision in US v. Munchel, DDC Judge Randolph D. Moss had before him the case of Capitol breach defendant Alan William Byerly. Inner City Press live tweeted it here
now Jan 6 case of US v. Alan William Byerly before District of DC Federal judge Randolph D. Moss. It is public accessible by call-in line [unlike US v. Ghislaine Maxwell trial, separate thread]
Byerly's lawyer: We working to receive the discovery, it's ongoing. There will be motions, so if the court wants to set a trial date with the motions built in.
Judge Moss: You're the defendant, tell me when you want to file your motions. Byerly's lawyer: Jan 14.
Judge Moss: And we'll have a hearing on February 10. I could pencil in a trial date today if you like. Byerly's lawyer: Yes let's pencil one in now. Judge Moss: How long does the US need for trial? Assistant US Attorney: I'm going to ask for a week.
Judge Moss: Including jury selection? AUSA: Yes. Clerk: We could say April 11, but the DC public school break makes it hard to get jurors.
[For those interested, here is the US v. Byerly Complaint and "Statement of Facts" here
Judge Moss: So, trial the week of April 11. Meanwhile, Mr. Byerly was directed to pay $250 a month for counsel and he has not been doing so.
Defense counsel: We'll be addressing that.
Adjourned.
