FEDERAL COURT, Nov 8 -- On November 8, months after the DC Circuit's decision in US v. Munchel, DDC Judge Trevor N. McFadden had before him the case of Capitol breach defendant Pauline Bauer, who according to her standby counsel is ready to plead guilty to a misdemeanor but from whom DOJ demands a felony plea. Pauline Bauer's stand-by counsel Hernandez says her investigator went to the jail to show Ms. Bauer her discovery, but it never left the investigations control so it couldn't be "shared."
Bauer was resisting DOJ's "protective order."
Bauer's stand-by counsel: The goal is that she not republish the info, and we aim to comply with that. But why should she have to sign that she if fully satisfied with my services in order to see the discovery against her? Judge McFadden: I'm inclined to agree
Judge McFadden: The government wants another status in 30 to 60 days. Bauer's stand-by counsel: Ms. Bauer has said she is willing to consider a plea. But they are not offering a misdemeanor. DOJ is adamant that they want a felony plea.
Judge McFadden: I suggest that the Marshals should allow Ms. Bauer to speak with both of you afterwards.
Bauer's stand-by counsel: There's the matter of her detention. She wrote a letter. She is not a risk to the community. All she did was refuse to call.
Bauer's stand-by counsel: Her sister is here again. Pauline Bauer is in danger of losing her business.
Judge McFadden: I'm taking this under advisement. Bye, folks. [Bauer was not heard from]
