FEDERAL COURT, July 2 -- On July 2 months after the DC Circuit's decision in US v. Munchel, DDC Judge Amit P. Mehta held a lengthy proceeding in the multi-defendant Oath Keepers case, setting a first trial for January 31 - February 22, 2022. Inner City Press live tweeted it, here: (podcast here)
now #insurrectionBlues case of US v. Jessica Watkins, Meggs, Caldwell, Crowl, Parker, et al - #OathKeepers.
Assistant US Attorney: We have been providing discovery. There remain a small amount of FBI reports for the ongoing investigation. And data from iCloud accounts, too large for USAfx [That's the platform on which they pretend videos are available to the public]
AUSA: We provided the video of these defendants, more next week, we'll get it out the door. [To where?] We'll still provide Capitol tours this summer, when Congress is not in session. Say, early August. By the end of the summer we should reach a conclusion
AUSA: We have been working with a third party vendor for discovery, and talking with the defense bar, mostly the public defenders. As to video, there are 1000s of hours. It's being put in the database, it will be made available to the defense by early August
AUSA: There are radio runs.. And grand jury subpoenas. We need to review it for things that are sensitive and should not be provided. That may take until the Fall.
Judge Mehta: Is the video searchable? [Inner City Press wrote to Judge Mehta for/re videos...]
AUSA: We assume that FPD [Federal Public Defenders office] will be working on tagging the videos.
A defense lawyer, who didn't state their name: We thought the government would share. But we'll have to come up with our own vendor and data base Public Defender: The national office is preparing a budget, it will be a lot of money we'll have to ask the court for.... The government uses Evidence.com to share. So we have to each have a license. And that's just for the body worn camera videos.
AUSA: We are ready to choose a trial date, but not which defendant will be in each, given pending plea offers. A defense lawyer: I have a September trial before Judge Boasberg... But it's not clear if it can go forward, it's a four defendant case.
It seems defense lawyer for Meggs has been left off e-mail lists, not sure he has all discovery, will be making a motion to get client out of pre-trial detention, wants trial ASAP (in detention since January).
Defense lawyer: There may be severance issues. And we'd like to know if there will be any more superseding indictments.
Another: We're ready for trial in January 2022. Last defense lawyer: This discovery is like drinking water from a fire hydrant.
Judge Mehta: Let's meet again on September 8 at 2 pm to hear motions. And for trial, hold free Jan 31 and Feb 22, a three week trial. 2d trial April 4-29 [2022].
Addendum in Oath
