SDNY COURT Exclusive, April 6 – In the U.S. District Court for the Southern District of New York on March 17, a bail or detention proceeding was held by Magistrate Judge Katharine H. Parker on a man who brandished a loaded rifle and handgun in a bodega in Manhattan's Chelsea neighborhood then was running away when he was tackled by a Good Samaritan and arrested.

  On March 17, Inner City Press was the only media in the Mag Court, even as the SDNY prosecutors put out a press release about the case, with short videos. (Now here and here)

  Jason Fleming's Federal Defender said his client is a good family man, and has a job repairing NYCHA housing projects.

  Judge Parker credited both, but after watching the videos said that home detention would not protect the community. She ordered Fleming detained.

On March 30, Jason Fleming still detained was formally indicted -- just the single count of felon in possession of a firearm -- and the case was assigned to District Judge Broderick.

On April 6, Judge Broderick held a bail appeal. Inner City Press was there, the only media, thread here:

Fleming pleads not guilty.

Judge Broderick: I understand there was a post arrest statement...

AUSA: We also extracted the phone. We need a protective order

Judge: I understand there's a bail appeal. I have a letter from Laneeah (sp) Contracting LLC, and pictures of Mr Fleming with children for whom he has taken on the responsibility as parent. I have seen the 3 video. FD: He doesn't have a passport.

Federal Defender: His partner is here. There is mitigating evidence. He did not fire the guns. He was drunk and emotionally unstable. He was trying to throw the revolver over the fence. He was trying to de-escalate

Federal Defender: It's just 922(g). He could get treatment, but not in the MDC. The warden says lock downs will continue for the foreseeable future.

Judge: Where's the bodega?

AUSA: He brandished both guns. A girl ran. He was dressed for a mass shooting.

Judge: Does the .357 have a serial number? AUSA: Yes. He holding it when the Good Samaritan tackled him. He has 3 prior firearm felonies.

Federal Defender: 922(g) may no longer be a crime of violence. Guns are a commerce problem. Guns can be sold in many jurisdictions, just not this one.  Judge: I am going to order Mr Fleming remain detained
