Retaliation Case Paused Pending Bari Weiss Substack Piece on Kevin Ray v The New 42 Street

SDNY COURTHOUSE, Jan 13 – Kevin Ray was employed by the NYC-based theater company The New 42 Street until he chafed at post-George Floyd diversity training. He filed a lawsuit.
On January 13, 2023 U.S. District Court for the Southern District of New York Judge Alvin K. Hellerstein held a proceeding. Inner City Press covered it.
The complaint cites "the common sense words of the Supreme Court: 'The way to stop discrimination on the basis of race is to stop discrimination on the basis of race.'" Parents Involved in Community Schools v. Seattle School District No. 1, 127 Sup. Ct. 2738 (2007).
Counsel for New 42 said they were near to consummating a monetary settlement, after Ray previously posted his critiques on YouTube and other "outward facing videos."
But now, New 42's lawyer said, there was another problem: an article forthcoming on Bari Weiss' Substack. Until they see it, he said, they will not consummate any settlement.
Judge Hellerstein inquired, but that was the lay of the land: everything on hold pending the forthcoming Substack.
