LITERARY SDNY, Oct 25 -- Twenty fifth day of October and now the game was on. Judge Kaplan had scheduled a 10:30 am conference with SBF's lawyers and the prosecutors, to ask about the schedule.
Mark Cohen for SBF, on a echoing phone line - was he in the MDC? One would think he would wave that flag or play that card if it were true -- said the defense would have three witness.
Oh, and that their client would testify.
There was no way to gauge the look on the participants face. Judge Kaplan had said, joking, that he would spare them his grim visage. But were they surprised? Was anyone?
How much time do you think it will take, Cohen was asked. He replied that the direct would be similar to those of Caroline, Gary or Nishad. It wasn't for him to say how long the cross would last.
Still the prosecutors insisted it might be possible to finish their cross examination on Friday, do the charge conference and have closing arguments on Monday or Tuesday, which would be Halloween.
How, if SBF did actually take the stand, would his cross examination not last for years, what with all the podcast and TV interviews chockablock with impeachment material?
Or maybe the prosecutors would just choose three clips, ask Sam to explain how they were consistent with what he was claiming now, and then say, "No further questions."
